The service "SRI" (hereinafter referred to as "App") is provided by the German respiratory league in cooperation with the Lungenklinik Köln-Merheim of the clinics of the City of Cologne (hereinafter referred to as "we" or "us").

We would like to give you the greatest possible transparency about the movement of your data. It goes without saying that we handle your data carefully, keep it safe and do not pass it on to third parties.

Please read the following privacy statement carefully before using the app. By downloading, installing, or using our software, you agree to this End User Agreement.

Within the framework of this app, we offer you continuous support in self-monitoring and the assessment of your health-related quality of life. This app gives you an overview of your latest results in the validated quality of life questionnaire for patients with respiratory insufficiency, as well as the opportunity to further explore various topics related to your lung disease in order to lead a more self-determined life. In addition, the collected data can be saved or sent in the form of a report at your request.

The use of the app explicitly does not replace a doctor's visit and serves rather to support this as well as self-control. The scope and nature of the personal data collected are subject to your free decision at any time. The protection of your privacy and the disclosure of which data is collected and why is of the highest priority to us. You can view this data protection declaration at any time under the menu item "Data protection" within the app.

§ A - General information

  1. Only if you send us personal data by post, e-mail or other means will additional information be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. We do not pass on this data without your consent. In addition, only the e-mail address required for registration will be stored. This is necessary to ensure that you are a natural person and to give you the opportunity to send a report by email.

  2. You can revoke your consent to the processing of your personal data at any time.

  3. You have the right to lodge a complaint with the relevant supervisory authority at any time.

  4. At any time you have the right to request information from us about the personal data concerning you that we have processed in accordance with Art. 15 DS-GVO.

  5. You have the right at any time to request that the data concerning you be rectified without delay if it is inaccurate.

  6. Certain information is already processed automatically when you use the app. We have listed below which personal data is processed exactly for you:

a. Information to download \
When you download the App, certain required information is sent to the App Store you select, including, but not limited to, your username, email address, customer number of your Store account, time of download, and your unique device identifier. The processing of this data is carried out exclusively by the respective App Store and is outside our sphere of influence.

b. Information that is collected automatically \
Within the scope of using the app, we collect certain data that is necessary for the use of the app. These include

• IP address • Date and time of the request • Content of the request • Operating system • http status code • Content from which the request comes • Operating system interface • Version of the app

This data is automatically transmitted and stored for seven days to provide the service and related functions; to fulfill the functions of the App; and to anticipate and prevent misuse and malfunctions. This data agreement is a necessary component for the fulfilment of the contract between you as user*in and us pursuant to Art. 6 para. 1 lit b) DS-GVO and is therefore justified.

c. Registration in the app and creation of a user account \
The creation of a user account is a prerequisite for the use of this app. This is a prerequisite for creating a pseudonymized "SRI-ID", so that you can now view your own profile independently of the device and medium and view your results from anywhere. To create a user account, an e-mail address and a password are required. Access to the user account is only possible with this user data.

The correctness of the given e-mail address will be ensured during the registration via confirmation link. The password is stored encrypted on the server side.

In addition, the e-mail address will be used if you wish to use the "Forgot password" function in the future, or if we have to send you legal notices and security messages. This data agreement is a necessary component for the fulfilment of the contract between you as user*in and us pursuant to Art. 6 para. 1 lit b) DS-GVO and is therefore justified.

d. Required entries for using the app \
In order to use the app, we need the following information:

• Age (in years)

• Existence of a long-term oxygen therapy

• Existence of ventilation therapy

We need this data to ensure that the SRI questionnaire is meaningful in your case, as it is a highly specific questionnaire validated for the following patient groups:

• Respiratory Insufficiency Type I

• Respiratory Insufficiency Type II

This data agreement is therefore a necessary component for the fulfilment of the contract between you as user*in and us pursuant to Art. 6 para. 1 lit b) DS-GVO and therefore justified

e. Accesses and Authorizations \ \

• Memory access: This is required so that your data can be stored within the app on your mobile device and you can save reports in .pdf format on your mobile device.

• Internet access: This is required for the app to exchange data with our server, such as user account authentication and synchronization of results.

This data agreement is a necessary part of the fulfillment of the contract between you as a user*in and us pursuant to Art. 6 para. 1 lit b) DS-GVO and therefore justified

B - Transmission and transfer of data

A passing on of your data, in particular to third parties such as analysis services and hosting services is explicitly not done to protect your privacy. A passing on happens only in such cases if your explicit previous consent is successful and if it is legally required. This may be the case in the future, for example, when processing is necessary to protect the vital interests of users*.

When necessary to investigate an illegal or abusive use of the App or for law enforcement purposes, personal data is transferred to law enforcement or other authorities. A transfer can also take place if this serves the enforcement of terms of use or other legal claims. Such disclosure of personal data is justified by the fact that processing is necessary to fulfil a legal obligation to which we are subject pursuant to Art. 6 (1) DS-GVO.

C - Transfer of data to third countries

All data will not be stored and processed outside Germany. A transfer from a third country does not take place

D - Data storage period

Your personal data will be treated according to the principle of purpose limitation. This means that your data will be stored with us for as long as it is necessary to fulfil the purpose of the processing. If this purpose is fulfilled, these are deleted again.

E - Purpose changes

Your personal data will only be processed for purposes other than those described, in particular for research purposes, if this is permitted by law or if you explicitly and

actively consent to the changed purpose. In the event of such further processing, we will inform you prior to further processing and provide you with all information.

F - Right of objection

You have the right to object at any time to the processing of your personal data on the basis of Art. 6 para. 1 DS-GVO in accordance with Art. 21 DS-GVO. We will cease processing your personal data unless it constitutes the basis for legitimate reasons for processing that override your interests and rights, or if the processing is for the exercise or defence of legal rights.

G - Right of appeal

H - Changes to the Privacy Policy

In order to adapt to the dynamics and constantly changing offers, we reserve the right to continue to adapt this privacy policy. The current and valid version is always the one available in the app.
